The person filing the case is known as the Plaintiff while the person responding to the service of process is known as the defendant. The Plaintiff or party involved in a case cannot personally serve the defendant the legal papers. Such legal papers include Summons and Complaint, a Notice of Petition and Petition, or a Motion against the defendant. In some cases, a Judge can make exceptions. The Judge can also make the Plaintiff start the case all over again if the papers are properly delivered. This is known as dismissal without prejudice. There are three delivery methods:
  1. Personal Delivery: Legal papers are handed directly to the defendant on any day during the hours of 6am – 10pm, except on Sundays and days of religious observation, in which no papers can be served.
  2. Substituted Delivery: The papers are delivered to a substitute who can give the defendant the papers while separate copies are mailed.
  3. Conspicuous Delivery: In case that the above two delivery methods are unsuccessful, the legal papers are placed in an area where the defendant is likely to find them while separate copies are mailed.

 

Proof has to be given to the court that the papers were delivered in a proper way. This is done through the Filing of an Affidavit.
