How To Serve your Wife in Staten Island

Researching how to serve your wife in Staten Island? First Class Process is glad to help. Legal matters can be a stressing factor in your life, but with the right people and services at your side, the whole divorce process can run smoother. The person starting the divorce case is known as the Plaintiff while the person being served is known as the defendant. When the time comes to legally notify the defendant of the action being taken, it is done through the serving of legal papers.
There are contested and uncontested divorces. Not sure of the difference? A contested divorce is one in which the defendant does not agree with the terms of the divorce, thus contesting it. An uncontested divorce is that in which both spouses agree with the divorce. In an uncontested divorce, the plaintiff does not have to worry about hiring someone to serve legal papers. However, for a contested divorce, a third party must be involved, such as a process server, to serve the right legal papers personally.
Here are the requirements and steps:

Serving The Defendant

  • Defendant cannot be served the legal papers by Plaintiff personally
  • Someone else who 18 years old or older must do it, such as process server by First Class Process
  • The papers that are being served in New York State must be served by a New York state resident
  • Papers must be served within 120 days from the date the papers were filed.
  • An Affidavit of Service must be filled, signed, notarized, and returned to the Plaintiff.
This specific procedure must be followed so that it can be upheld in court. If you are ready to take these steps, First Class Process is ready to help.
